The Gauhati High Court today granted interim bail to Nasim Akram, who has been in custody since November 12 in connection with a social media post relating to the recent blast in Delhi. The bench, headed by Justice Sanjeev Kumar Sharma, accepted the petition filed by Akram’s counsel, D.K. Agarwala, noting that the content of the post did not, on the surface, amount to sedition.
Nasim Akram, a resident of Uttar Bandarmela in Hojai district, had posted a comment on social media saying, “Before every election, we see there is a bomb blast like this, and after that there is story.” He was arrested under multiple sections of the Bharatiya Nyaya Sanhita (BNS), 2023, specifically 152, 192, 196(1), 197, and 353, in connection with Murajhar Police Station Case No. 235/2025. His arrest was part of a wider operation in Assam, where authorities detained more than 21 individuals for allegedly posting content that either glorified or expressed support for the Delhi blast.
During the hearing, the state authorities argued that such posts could incite violence and disturb public order. However, the court observed that the post, on its face, did not meet the threshold required for sedition under law. Taking into account that Akram had spent nearly three weeks in custody, the court allowed him interim bail, setting a surety of Rs. 50,000. The order also stipulated that Akram must not abscond, must remain available for trial, must not interfere with the ongoing investigation, and must refrain from committing any illegal acts while on bail.
The next hearing in Akram’s case is scheduled for January 6, 2026.
